Terms of Use

These Terms of Use ("Terms") govern your use of the Ask Fenix mobile application ("Ask Fenix", "the App"), provided by Andrew Morrissey ("we", "us"). By downloading, accessing, or using the App, you agree to these Terms.

1. The Service

Ask Fenix is a voice companion app offering spoken conversation and guided breathing exercises ("Breath Flow"). Responses are generated using third-party AI services and delivered back to you as synthesized speech.

2. Subscriptions & Billing

Ask Fenix is offered on a free-trial basis followed by a paid auto-renewing subscription, billed through your Apple ID account:

• A 3-day free trial is available to new subscribers.
• After the trial, your subscription automatically renews at the plan price you selected (Monthly or Yearly) unless canceled at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription anytime in your device's Settings > [Your Name] > Subscriptions.
• No refund will be issued for the unused portion of a subscription period, except where required by law or Apple's App Store policies.

3. Not a Substitute for Professional Care

Ask Fenix is intended for general relaxation, reflection, and breathing exercises. It is not a medical device, and it does not provide medical, psychological, or emergency services. It is not a substitute for professional mental health care. If you are experiencing a crisis, please contact a licensed professional or your local emergency services immediately.

4. Acceptable Use

You agree not to misuse the App, including attempting to interfere with its normal operation, reverse-engineer its backend services, or use it for any unlawful purpose.

5. Intellectual Property

All content, branding, and software associated with Ask Fenix remain the property of their respective owners. You are granted a limited, non-transferable license to use the App for personal, non-commercial purposes.

6. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated responses will always be accurate or appropriate.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
